La Calabria può diventare la prima Regione italiana ad adottare una legge organica sull’Antimafia Penitenziaria e a costruire un modello innovativo di contrasto alle organizzazioni criminali negli istituti di pena.
È questo il messaggio ho lanciato come Garante regionale dei diritti delle persone private della libertà personale della Calabria e Coordinatore nazionale dei Garanti regionali, a seguito dell’audizione presso la Commissione regionale contro la ’ndrangheta, nel corso della quale sono stati presentati cinque allegati operativi, tra cui due proposte di legge regionale.

Desidero ringraziare il Presidente del Consiglio regionale della Calabria, l’Ufficio di Gabinetto, il Presidente della Commissione anti ’ndrangheta e tutti i componenti per avere colto, durante l’audizione del 12 giugno scorso, la portata strategica di una proposta che guarda al futuro del contrasto alle mafie e alla qualità della nostra democrazia. Sono certa che non faranno mancare il loro autorevole sostegno a questo Ufficio.

Secondo me, la Calabria ha oggi l’opportunità di assumere un ruolo guida a livello nazionale, candidandosi a diventare la Capitale italiana dell’Antimafia Penitenziaria. Non si tratta di un primato simbolico, ma di mettere a disposizione dell’Italia l’esperienza maturata in una terra che ha conosciuto la forza della ’ndrangheta e che può contribuire a costruire nuovi strumenti di prevenzione, sicurezza e legalità».
L’Antimafia Penitenziaria nasce dalla consapevolezza che il carcere non rappresenta un luogo separato dal fenomeno mafioso. Le organizzazioni criminali hanno molto potere e lo sfruttano al fine di mantenere relazioni, comunicazioni e catene di comando anche durante la detenzione.

Le mafie si combattono con le indagini, con i processi e con le condanne, ma anche impedendo che possano rigenerarsi all’interno degli istituti penitenziari. Il lavoro svolto dalle forze di Polizia anche all’interno degli Istituti e dai nuclei speciali è encomiabile, ma adesso serve un cambio di passo e maggiore operatività tra diverse istituzioni.

Tra gli obiettivi della proposta figurano: riconfigurazione di un impianto normativo regionale di settore competitivo nel contrasto delle mafie, il contrasto all’ingresso di droga, telefoni cellulari e strumenti di comunicazione illegale, la tutela del lavoro della Polizia Penitenziaria e di tutto il personale che opera negli istituti, la promozione della legalità, della ricerca, della formazione e della prevenzione. «Insomma una nuova cultura della sicurezza e dei diritti percepiti non più come concetti alternativi. Essi, sono due pilastri di una avanzata strategia democratica. Non esiste sicurezza senza diritti e non esistono diritti senza sicurezza».

La proposta punta alla creazione di una rete permanente tra Regione, Amministrazione Penitenziaria, Magistratura, Università, Forze dell’Ordine, sistema sanitario e Terzo Settore, con l’obiettivo di sviluppare un modello stabile di osservazione, prevenzione e contrasto alle infiltrazioni criminali negli ambienti detentivi.
La Calabria può diventare il primo laboratorio nazionale di cultura operativa della legalità negli ambienti più difficili, contribuendo alla costruzione di una nuova politica pubblica capace di unire sicurezza, prevenzione, ricerca, trattamento e dignità della persona.
